The petitioner seeks bail in Begusarai Town P.S. case No. 83 of 2016 under Section 457, 380 of the Indian Penal Code. The informant lodged the case for theft in his house against unknown. The informant also mentioned the articles and ornaments stolen from his house.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. The petitioner is a jeweler, who is running his shop in the name and style of Raja Ram Jewelers. Name of the petitioner figured in the case in the statement of Ajay Kumar Suliya @ Lala, who disclosed that he sold the stolen ornaments to the petitioner. It is submitted that no ornaments
Patna High Court Cr.Misc. No.54299 of 2016 (3) dt.28-02-2017 2/2 resembling stolen articles was recovered from the shop of the petitioner nor any recovered article was put on T. I. parade. The petitioner is in jail since 29.08.2016.
Considering the fact that recovered articles were not put on T. I. parade and petitioner is in jail for last six months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Begusarai Town P.S. Case No. 83 of 2016.
