NILU AGRAWAL ORAL ORDER 09-01-2019 Heard the learned counsel for the petitioner, the learned counsel appearing for the State as well as the learned counsel appearing for the Accountant General, Bihar, Patna. Petitioner, who retired from the Rural Works Department on 31.05.2017 seeks payment of his retiral benefits. He submits that even the amount of third ACP has not yet been given and claims the same. He submits that a latest representation has been filed before the respondent no. 4 the Executive Engineer, Rural Works Department, Works Division, Bagaha 1, West Champaran, with a copy to respondents 1 and 5,

Patna High Court CWJC No.420 of 2019(2) dt.09-01-2019 2/2 i.e., the Secretary, Rural Works Department, Government of Bihar, Patna, and the Collector, West Champaran at Bettiah, on 12.11.2018, as contained in Annexure 5, but, still his dues are not paid.

Considering the nature of claim, made by the petitioner, this writ application is disposed off with a direction to respondent no. 4, the Executive Engineer, Rural Works Department, Works Division, Bagaha 1, West Champaran, to dispose of the representation filed on 12.11.2018 within a period of three months from the date of receipt/production of a copy of this order. Any amount, due, would be paid to the petitioner within two months thereafter. If certain amount is found inadmissible, the same shall be communicated to the petitioner by speaking order through registered post.
