Victim, Ajmira aged about 13 years became traceless in the night of 22.09.2014. During course of search, informant, her father received telephone from Md. Monajir, brother of petitioner disclosing that he along with Md. Suktar and others kidnapped her for the purpose of marriage. Victim has been traced out and her statement under Section 164 Cr.P.C. has been recorded wherein, she had alleged against the petitioner to have kidnapped her, confined her in his custody, however, had not misbehaved with her.

On account thereof as well as taking into account the period of custody since 18.11.2014, petitioner, Md. Sukhtar @ Md. Suktar is directed to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.21813 of 2015 (02) dt.07-07-2015 bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. A. R. Upadhyay, Judicial Magistrate, 1st Class, Bhagalpur in connection with Kahalgaon (Budhu Chak) P. S. Case no.28 of 2014.
