The petitioners are languishing in custody since 1304.2015 in a case registered for the offences punishable under section 379 of the Indian Penal Code.

Accusation is of stealing the dwell SIM mobile of the informant. Subsequently, the mobile was recovered from the petitioner Md. Naushad.

It is submitted by learned counsel for the petitioners that for the occurrence of 28.03.2015, the FIR was lodged on 01.04.2015. However, the investigation has already concluded and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.22354 of 2015 (2) dt.09-07-2015 2/2 Considering the aforesaid fact, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in connection with Sonepur Rail P.S. Case No.15 of 2015.
