As both these bail applications have cropped up from the same police station case number, hence, with consent of parties, they are being heard together and disposed of by this common order.

The petitioners apprehend their arrest in connection with

Patna High Court CR. MISC. No.75176 of 2022(3) dt.04-05-2023 2/3 Sikarpur P.S. Case No.517 of 2020, registered for the offence punishable under Sections 406, 409, 420, 34 of the Indian Penal Code.

There is allegation of defalcation of Government money, breach of trust and forgery regarding "Mukhyamantri Gramin Payjal Nishchay Yojana" and "Mukhyamantri Gramin Gali Nali Pakkikaran Nishchay Yojana" against the petitioners. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that there is no allegation that the petitioners have embezzled any money out of the present schemes.

The petitioners were not connected with the financial power in the matter of execution of the schemes in question and there is no charge of over measurement against the petitioners. Petitioners have no criminal antecedent. Learned APP for the State opposed the prayer for anticipatory bail.

Patna High Court CR. MISC. No.75176 of 2022(3) dt.04-05-2023 3/3 Mukhyamantri Gramin Payjal Nishchay Yojana and Mukhyamantri Gramin Gali Nali Pakkikaran Nishchay Yojana was not implemented in the Gram Panchayat Raj Rajpur Tumkadiya, Ward No.13 and 14 and has found so many irregularities in the implementation of the said schemes. Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioners on bail. The prayer for grant of anticipatory bail on their behalf is hereby rejected.
