In the present case, the petitioner is challenging the action of the authority in granting permit without formulating the route which is per se illegal in terms of Section 68(3) (Ca) of the Motor Vehicle Act and Rule 66 (2) and 66(11) of the Motor Vehicle Rule.

Earlier similar type of question was raised in C.W.J.C. No. 9161 of 2016 and CWJC No. 18391 of 2015 and this Court has given direction to raise all the points before the State Transport Authority.

Patna High Court CWJC No.6598 of 2017 dt.22-06-2017 In that view of the matter, let the petitioner should raise his grievance before the North Bihar Regional Transport Authority, Muzaffarpur, who will consider the same and will take a decision in accordance with law.
