====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 15-03-2023 Heard Mr. Priyadarshi Pankaj Raj Anand, learned counsel appearing on behalf of the petitioner and Mr. Atul Chandra, learned APP appearing on behalf of the State.
2. Petitioner seeks bail in connection with Nautan P.S. Case No. 63 of 2020 registered under Sections 302, 307 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Petitioner had earlier moved before this court for grant of regular bail by filing Cr. Misc. No. 24077 of 2021 which was rejected by this Court on 02.03.2022 with liberty to the petitioner to renew his prayer for bail, if no substantial progress takes place in the trial.
4. A report was called for from the court below with respect to the stage of the trial vide order dated 15.02.2023 and in compliance of the same, the Additional District and Sessions
Patna High Court CR. MISC. No.7277 of 2023(3) dt.15-03-2023 2/2 Judge-VII, Siwan vide Letter No. 177 dated 25.02.2023 has informed that all the prosecution witnesses have already been examined and only defense witnesses are remained to be examined.
5. Considering the fact that the trial has progressed considerably, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the bail application stands rejected.
6. The trial court is directed to conclude the trial expeditiously, preferably within a period of three months. (Purnendu Singh, J) mantreshwar/- U T
