The petitioner being husband of the informant is languishing in custody since 13.03.2015 in a case registered for the offences punishable under sections 323, 341, 498a, 313, 376, 506, 509,34 of the Indian Penal Code.

Accusation is of making assault and torture to the informant. It is alleged that the brother-in-law of the informant namely Dilip Mandal established forceful physical relationship with the informant in 2012 when the informant got pregnant, the father-in-law and mother-in-law got her pregnancy terminated. It is submitted by learned counsel for the petitioner that the accusation of committing rape is against co-accused

Patna High Court Cr.Misc. No.22397 of 2015 (2) dt.09-07-2015 2/2 Dilip Mandal whereas the accusation under section 313 IPC is against the parents of the petitioner and the investigation has already concluded.

Considering the thrust of accusation is against coaccused Dilip Mandal, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No.338 of 2014.
