The petitioner seeks bail in Special Case No.31 of 2019, arising out of Sadar P.S. Case No.566 of 2019 registered for the offence punishable under Sections 08/21/22(b) of the NDPS Act.

As per the prosecution report, there is recovery of 13.70 gms of Smack from the possession of the petitioner and also recovery of 12.25 gms. of Smack , kept beneath the dash board of the car, from which they were moving. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he is in custody since 08.11.2019 Further submission is that nothing has been recovered from the conscious possession of the petitioner. Heard learned Addl. Public Prosecutor.

In view of facts and circumstances, as stated above, I am not inclined to enlarge the petitioner on bail at this stage, however once the charge is framed in this case, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application for bail is dismissed.
