The petitioner in the present case is seeking pre-arrest bail in connection with Barahara P.S. Case No. 335 of 2021 registered for the offences punishable under Sections 414, 413/34 of the Indian Penal Code. He has got no criminal antecedent.
As per the prosecution story, the informant received secret information regarding keeping stolen motorcycle by some people in village- Kalambagh. It is alleged that from petitioner's house one black color, Super Splendor motorcycle bearing registration no. BR01J-8098 has been recovered. Learned counsel for the petitioner submits that from the FIR it is evident that one Nakul Mandal is involved in sale and purchase of the stolen motorcycle and the petitioner is
Patna High Court CR. MISC. No.4879 of 2023(2) dt.16-05-2023 2/2 falsely implicated in this case.
Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.
Having regard to the facts and circumstances of the case, it appears that a stolen motorcycle is said to have been recovered from the house of the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner in case, however, the petitioner surrenders within four weeks from today and prays for a regular bail, his prayer for regular bail shall be considered on its own merit and shall be disposed of expeditiously.
This application is dismissed.
