The petitioner is accused in connection with Baligaon P.S. Case no. 38 of 2015 registered under Sections 147, 148, 149, 435, 427, 387 and 506 of the Indian Penal Code, Section 17 of C.L.A. Act and Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. and in course of investigation, the petitioner was apprehended by the Police in connection with Bhagwan P.S. Case No. 143 of 2015 on the basis of confessional statement of co-accused and thereafter, Police got recorded the confessional statement showing his involvement in Baligaon P.S. Case No. 39 of 2015 and in the present case. Further submission is that except the confessional statement there is
Patna High Court Cr.Misc. No.13670 of 2016 (2) dt.21-04-2016 2/2 nothing on the record showing his involvement in Baligaon P.S. Case No. 38 of 2015. Further submission is that in both the aforesaid cases petitioner is on bail. The petitioner is in custody since 10.10.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali in connection with Baligaon P.S. Case No. 38 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and furnish the correct address of the petitioner in case of change of address.
