====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner, counsel for the informant and the State.
The petitioner seeks bail in Khagaria P.S. Case No. 592 of 2018, instituted for the offence under Section(s) 406, 342 and 506/34 of the Indian Penal Code. It is alleged in the written report that informant was doing business of Saree with this petitioner in the name of Mithi Textile. It is further alleged that informant supplied Saree from his firm to the petitioner worth Rs.16,22,316/- on credit in the name of Mithi Textile, Khagaria. In spite of best efforts, only Rs.6,98,000/- has been returned and remaining Rs.9,24,316/- is still due.
Patna High Court Cr.Misc. No.2645 of 2019(2) dt.21-01-2019 2/2 It is mentioned in paragraph-7 of the bail petition that petitioner has made payment on different dates through Punjab National Bank amounting to Rs.6,21,190/- and Rs.7,79,740/- through Vijaya Bank.
This Court finds that this is a matter of business disputes between the parties.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S.
