JUSTICE ASHUTOSH KUMAR ORAL ORDER 31-03-2022 Heard Mr. Dhirendra Nath Jha, the learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Lodipur P.S. Case No. 125 of 2020 instituted for the offences under Sections 147, 148, 452, 354(B), 380, 323, 307385, 504, 506 of the Indian Penal Code.

By order dated 03.03.2022, case diary was called for and the petitioners were granted provisional bail. All the petitioners are said to have assaulted the

Patna High Court CR. MISC. No.15063 of 2021(3) dt.31-03-2022 2/2 members of the prosecution party but only one person, namely, Punam Devi has received injuries.

Till the date of the passing of the aforesaid order, the nature of injury of Punam Devi could not be assessed for want of further medical investigation.

The final medical investigation now indicates that there is no bony fracture.

The learned counsel for the petitioners has submitted that even that injury is not attributable to anyone of the petitioners but to someone else who is not the petitioner before this Court.

Considering this aspect of the matter, the provisional bail granted to the petitioners is hereby confirmed.

The petitioners shall remain on the same bail bonds.
