It is not in dispute that Ram Krishna Singh and Ravita Devi, the husband and the wife respectively, have got divorce by mutual consent from the Court of Principal Judge, Family Court, Bhojpur at Ara in HMA No. 392 of 2022 and their marriage has been dissolved by a decree of divorce by mutual consent by order dated 19th December, 2023 and the parties have also prayed for quashing of the present criminal case also.
3. In view of the above, this application is allowed and the order dated 15.10.2018 passed by the learned SubDivisional Judicial Magistrate, Bhojpur, Ara in Agiaon Bazar P.S. Case No. 8 of 2017 and all the consequential proceedings arising out of the same are hereby quashed.
4. The photocopy of the divorce decree is taken on record.
