JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and it is alleged that two persons were caught on the spot just after the alleged occurrence. The apprehended accused persons disclosed the name of petitioner and, thereafter, petitioner was arrested and on the basis of his discloser, two country made pistols and four live cartridges were recovered and except the aforesaid materials as well as criminal antecedent, there appears to be nothing against the petitioner. Moreover, co-accused Sanjeev and Bikram, who were caught on the spot, have already been granted privilege of bail by a co-ordinate Bench of this Court.

Accordingly, petitioner is directed to be released

Patna High Court Cr.Misc. No.22844 of 2015 (2) dt.07-07-2015 2/2 on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, and Patna in connection with Agamkuan P.S.Case No. 68 of 2014.
