JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Kurtha P.S. Case No.138 of 2019, disclosing offences under Sections 147, 149, 323, 332, 353, 427, 504 and 506 of the Indian Penal Code and Section 3 and 4 of the Prevention of Damages to Public Property Act. Police got information that several villagers surrounded some persons and assaulted by fits and slaps, on that information police reached there and took them to the police station, where several persons including the petitioners damaged the police jeep also.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.3578 of 2020(2) dt.21-01-2020 2/2 that no specific allegation has been attributed against them. Further submission of learned counsel for the petitioners is that other accused persons have already been granted anticipatory bail by a co-ordinate Bench of this court vide order dated 18.12.2019 passed in Criminal Misc. No. 84084 of 2019. Heard A.P.P. who has opposed the prayer for anticipatory bail.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of C.J.M., Arwal, in connection with Kurtha P.S. Case No. 138 of 2019.
