The petitioner is accused in connection with Nauhatta P.S. Case No. 186 of 2015, registered under Sections 148, 149, 448, 380, 504, 427, 506, 364 and 384 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that 45 persons named in the F.I.R. including the petitioner variously armed with weapon came at the door of the informant and Ram Lakhan Yadav after making firing entered in the house of the informant and looted cash, ornaments and other articles from the house of the informant. At that time, co-accused Ram Chandra Yadav also made firing and they also cut the bamboo and they started constructing the

Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. but there is no specific overt act against the petitioner. Moreover, the occurrence is said to be happened due to land dispute and similarly situated co-accused have already been granted privilege of Anticipatory bail by a coordinate Bench of this Court vide order dated 29.02.2016 passed in Criminal Misc. No. 9230 of 2016. The petitioner is in custody since 09.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.S.
