JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2019 The present writ petition has been filed for quashing the order dated 27.12.2018 whereby and whereunder the respondent no.9 has been authorised to function as the Incharge Warden of Kasturba Gandhi Balika Vidyalaya, Sakra notwithstanding the fact that the writ petitioner is already working there as the Incharge Warden, since her date of appointment.
The learned counsel for the respondents has filed a
Patna High Court CWJC No.529 of 2019(4) dt.19-02-2019 2/2 counter-affidavit today, which is taken on record. In the said counter affidavit, an office order dated 11.02.2019 issued by the District Education Officer, Muzaffarpur has been annexed whereby and whereunder the respondent no.9 has been transferred to her original place of posting i.e. Kasturba Gandhi Balika Vidyalaya, Gaighat and one more order dated 11.02.2019 issued by the District Education Officer, Muzaffarpur has been annexed, whereby and whereunder the respondent no.9 has been directed to handover charge to the petitioner herein.
Having regard to the facts and circumstances of the case as also in view of the aforesaid two letters issued by the District Education Officer, Muzaffarpur dated 11.02.2019, the learned counsel for the petitioner does not wish to press the present writ petition.
Accordingly, the present writ petition is disposed of as not pressed.
