The petitioner is languishing in custody since 18.05.2018, in a case registered for the offences punishable under Sections 411, 413 and 414/34 of the IPC.
The prosecution case, as per the written report of Bilash Prasad Singh, S.I. of Police, dated 18.05.2018, submitted to the Station House Officer, Samastipur Town Police Station, is to the effect that on 17.05.2018, while the informant was on patrolling duty, he received a secret information that by the motorcycle, which was stolen from near the Aditya Vision Electric shop, situated at Magardahighat, one person is moving near Kashipur Hanuman temple, whereupon raid was laid and one person was
Patna High Court Cr.Misc. No.5988 of 2019(2) dt.04-02-2019 2/3 apprehended in suspicion condition, who disclosed his name as Abhiranjan Kumar, the petitioner. On his disclosure, raids were also laid on different places and 12 stolen motorcycles were recovered.
It is submitted by learned counsel for the petitioner that prior to the registration of this case, the petitioner was not having any criminal antecedent, but after registration of this case, the petitioner has been remanded in nine other cases, out of which, in five cases, the petitioner is on bail. It is further submitted that from the materials on record, it does not appear that either the petitioner or the recovered motorcycle was put on T.I. Parade. Moreover, the investigation has already been concluded and similarly situated co-accused persons have been granted bail by different Benches of this Court, vide Cr. Misc. Nos. 48500, 49787, 51960, 55380, 61764 and 63173 of 2018. Learned APP submits that stolen motorcycle has been recovered from the possession of the petitioner. Considering the fact that the petitioner has been roped in nine other cases after registration of the present case, but recovery has been made only in the present case, recovered motorcycle has not been put on T.I.
