The petitioner seeks bail in a case under section 307 and other allied sections of the Indian Penal Code. Later on section 302 of the Indian Penal Code was added. The informant named the petitioner along with other accused persons and alleged that the petitioner assaulted the informant with Pharsa. Munna Prasad Chaurasiya is alleged to have assaulted Sahdeo Chaurasiya, younger uncle of the informant who later on succumbed to the injuries.
It is submitted that there is a counter version of the occurrence. Similarly situated co-accused Rajesh Chaurasiya and Arun Kumar Chaurasiya have been enlarged on bail by order
Patna High Court Cr.Misc. No.23611 of 2015 (2) dt.09-07-2015 dated 12.01.2015 vide Criminal Misc. No. 1098 of 2015 and coaccused Om Prakash Chaurasia and Dharmendra Prasad have also been enlarged on bail by order dated 10.03.2015. Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar III, Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 108 of 2014.
