The petitioners are apprehending arrest in connection with Chanpatia (Kumarbag) P.S. Case No. 364 of 2019 for the offence under Sections 147, 148, 149, 323, 353, 307, 384, 506 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution case, 200-300 rival groups variously armed present at the wrack point and attacked on each other.

Learned counsel for the petitioners submits that the petitioners were the members of the mob of 200-300 persons and there is no specific allegation against them.

No.5590 of 2020(3) dt.01-07-2020 2/2 Considering the fact that the petitioners were the members of the mob of 200-300 persons without any specific allegation, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia (Kumarbag) P.S. Case No. 364 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the condition that the petitioners on release will render their services as volunteer for a period of one month in dedicated Covid Hospital. They are required to report to the District Nodal Officer in the concerned region, who shall utilize their services in this pandemic.
