JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2016 Heard learned counsel for the petitoner and the State. The petitioner being husband of the informant is languishing in custody since 28.11.2015 in a case registered for the offences punishable under Sections 498A, 494 and 307/34 of the Indian Penal Code.

The accusation is of torture and performance of second marriage. Accusation against the petitioner along with Sarita Devi assaulted the informant.

It is submitted that the informant is the first wife of this petitioner who is living separately and maintaining herself by cultivating the land of her share. The injury report of the informant suggests simple injury caused by hard and blunt substance whereas the accusation has been levelled against the petitioner of

Patna High Court Cr.Misc. No.14043 of 2016 (2) dt.30-03-2016 2/2 assault made by spade. The investigation has already been concluded.

Considering the facts and circumstances, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additonal Chief Judicial Magistrate, Birpur in connection with Birpur (Balua Bazar) P.S. Case No. 214 of 2015.
