Petitioner seeks bail in a case registered under section 354 of the Indian Penal Code and 8/18 of the POCSO Act. According to the written report of the victim Nazrana Khatoon while she had gone out of her house near a drain to make water a driver of oil tanker came from behind from Chandralok Chowk and lifted her and while he was taking her towards the tanker she screamed loudly whereupon her father, mother, aunt and people of the vicinity rushed and on seeing them coming driver and cleaner of the tanker fled away. On behalf of the petitioner it has been submitted that the petitioner is in custody since 28.02.2015. It is further
Patna High Court Cr.Misc. No.22150 of 2015 (2) dt.16-07-2015 2/2 submitted that during the trial the victim has refused to identify the petitioner in her deposition. The father of the victim also refused to identify the petitioner.
On behalf of the State it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge POSCO, Muzaffarpur in Mohammadpur P.S.
