Petitioner seeks bail in a case registered under sections 328, 307 and other allied sections of the Indian Penal Code. No doubt, petitioner and one Ramjan Khan are said to meet with the informant but according to the prosecution case itself, it was co- accused Ramjan Khan who gave intoxicated biscuit to the informant.

Moreover, in course of investigation, mobile was recovered from the house of co- accused Ramjan Khan who disclosed the involvement of the petitioner.

It appears that except the aforesaid material, there is nothing against the petitioner who does not have any criminal antecedent and is languishing in jail custody since 1.1.2016. Accordingly, petitioner is directed to be released on bail on

Patna High Court Cr.Misc. No.13905 of 2016 (2) dt.07-04-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Anwar Shamim, Judicial Magistrate, Ist Class, Bagaha District West Champaran in Semra P.S. Case no. 74/2015.
