2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 338, 336(3), 340(2), 318(4), 61(2), 308(4) of the B.N.S.
3. The FIR discloses an allegation of sale of piece of land by the petitioner although a partition suit was pending between the parties.

Learned counsel for the petitioner submits that as a matter of fact, the land was a part of joint family property and the petitioner sold the said piece of land as the same came in her ownership and title by virtue of sale deed executed by her husband. It has also been submitted that with regard to the same piece of land, the informant's father has already filed cancellation of the sale deed and having resorted to the civil
Patna High Court CR. MISC. No.3427 of 2026(2) dt.28-01-2026 2/2 remedies, he has also filed the present criminal case against the petitioner and others. It has also been submitted that the present piece of land does not fall within the purview of schedule of land in the partition suit nor any decree has been made with regard to the said land
5. Learned APP for the State has opposed the application for anticipatory bail.

Taking into consideration the facts and circumstances and also considering the fact that the case essentially involves civil dispute and the informant after having taken recourse to civil remedies has filed the present case after lapse of three years, let the above named petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Turkauliya P.S. Case No. 416 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
