The records reveals that in the year 1997 vide letter No. 10029, dated 07.10.97, the Deputy Managing Director, Bihar State Land Development Bank, Patna, the measures were taken to disburse first installment of loan and the petitioner proceed with their projects of banana plantation. The petitioners grievance is that they could not carry on with their projects due to non disbursement of second installment of loan. The petitioners are aggrieved with the action of the Deputy Manager Land Development Bank, who has illegally rejected their claim for second installment.

Learned counsel appearing on behalf of the petitioners submitted that they engaged themselves in plantation on the assurance of the State Government and due to the failure of respondent no.3, the petitioners faced hardship and they were forced to file the present writ petition. The petitioners filed several representations praying for disbursement of the second installment but till date in want of any order no disbursement of loan has been directed to be paid to the petitioners.

In above circumstances, petitioners are directed to make their representation along with all evidences before the respondent no.2 Managing Director, Bihar State Co-operative and Development Bank/Society, Budh Marg, Patna. If the petitioners are entitled to the loan then the same be disbursed within short time. In case the claim of petitioner is not sustainable then the respondent no.2 is directed to dispose of the representation of the petitioners after giving them opportunity of hearing within a period of four weeks.
5. With the above observations and directions, the present writ petition stands dispose of.
