The petitioner seeks bail in a case under Section 376/511 of the Indian Penal Code.

The petitioner is alleged to have confined the victim in a room and after her disrobing her tried to commit rape but she raised alarm and the petitioner could not succeed. It is submitted that petitioner has falsely been implicated in the case as the petitioner had earlier filed a case against father of the victim and others. The petitioner is in jail since 26.05.2015 and he has already remained in jail for about four months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner

Patna High Court Cr.Misc. No.23204 of 2015 (4) dt.22-09-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Patna in Spl. Case No. 52/15 arising out of Masaurhi P.S. Case No. 221/14.
