JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has already been recovered and in her statement recorded under section 164 of the Cr.P.C., the victim stated that she was taken away by the petitioner to Danapur Station where she remain stayed for two days and except the aforesaid act, petitioner did nothing.

The contention on behalf of the petitioner is that petitioner is next door neighbour of the victim and, as a matter of fact, they were in love and the victim left her home voluntarily without any allurement though the victim was minor. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.13912 of 2016 (2) dt.05-04-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Patna city, Patna, in connection with Malsalami P.S.Case No.292 of 2015.
