====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-03-2020 This application has been filed by the petitioners for restoration of CWJC No.14286 of 2016, which was dismissed for want of prosecution.
It is submitted by the learned counsel for the
Patna High Court MJC No.4637 of 2018(4) dt.04-03-2020 3/3 petitioners that after filing of the writ petition it was listed under the heading 'For Admission' and vide order dated 15.05.2017 it was directed to be listed again under the same heading after disposal of Civil Review No.38 of 2013. Aforesaid civil review application was disposed of on 31.08.2017. Thereafter, the case was again listed for admission and, on 26.10.2018, the same was dismissed for want of prosecution, because of the fact that learned counsel for the petitioners Mr. Karuna Nath Sahay was in Court No. 11. He had instructed his clerk to watch the case and inform him, but due to sudden collapse of the cause list, the advocate clerk could not inform him in time and the case was called out and dismissed for want of prosecution. Considering the submissions made above, the restoration application is allowed.
CWJC No.14286 of 2016 is directed to be restored to its original file.
