====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 28-02-2022 Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in connection with Sasaram Nagar P.S. Case No. 294/2020 for the offence registered under Sections 341, 323, 325, 307, 337, 338 and 504/34 of the I.P.C.

The prosecution story, in brief, is that on 23.05.2020 at about 1.00 P.M., the informant, her husband alongwith the villagers went to the petitioner and others to stop illegal trafficking in which the they were alleged to be involved upon

Patna High Court CR. MISC. No.16263 of 2021(2) dt.28-02-2022 2/3 which they assaulted them. Co-accused Pappu Alam assaulted with an Iron rod upon the head and hand of Dhanjee Kumar. The petitioners also started pelting stones and bricks upon the Mohalla people.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is case and counter case between the parties. Free fight is alleged to have taken place between the parties. A petition has been filed by the informant in the learned court below where she has retracted from her earlier statement made in the F.I.R. The said petition is Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
