JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Bodhgaya P.S. Case No. 236 of 2020, registered for the offences punishable under Sections 7 of the E.C. Act.

As per allegation, the petitioner being a PDS dealer, he sold the subsidized food grains in open market by black marketing. When the raiding parties conducted raid in his shop the physical verification of his shop and godown was not in accordance with the entries made in Pos machine. There is also allegation that he was distributing ration to the beneficiaries in lesser quantity than that of they were entitled to receive.

Patna High Court CR. MISC. No.4656 of 2022(2) dt.22-08-2022 2/2 Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. He has also submitted that petitioner is ready to deposit the entire amount of the ration which was found mismatched.

Considering the above mentioned facts and circumstances, the anticipatory bail is provisionally allowed for four months, in the event of his arrest or surrender within four weeks before the learned court below, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S. Case No. 236 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The petitioner is directed to deposit the entire amount after being estimated by the Block Supply Officer. After deposit of entire amount within four months his bail bond shall be confirmed by the court below itself.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/nikuU T
