2. Learned counsel for the petitioner submits that by way of present application, the petitioner has challenged the order dated 09.01.2023 passed by the Additional District & Sessions Judge-V, West Champaran at Bettiah in S.Tr. NOo. 853 of 2022 arising out of Majhauliya P.S. Case No. 195 of 2019 by which the petition filed by petitioner for discharge under Section 227 of the Cr.P.C. has been rejected but, during pendency of the present application, charges came to be framed against the petitioner and trial has now commenced in which two prosecution witnesses have been examined, thus, he seeks permission to withdraw this application.

2. Permission, as sough for, is accorded.
