The petitioner apprehends his arrest in connection with Complaint Case No. 211(c) of 2019 registered under Section 498(a) of the Indian Penal Code and 4 of the D.P. Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Further submission is that in the present case, complaint case is lodged after lapse of one year. Prior to filing of the present case, one more complaint case (Annexure2) was filed by sister-in-law of the petitioner against the father of opposite party no.2. Opposite Party no.2 in retaliation of the

Patna High Court CR. MISC. No.4416 of 2020(2) dt.23-01-2020 2/2 said complaint case, filed a case before Mahila P.S. at Gardanibagh, in which notices was issued to the petitioner for his appearance. Thereafter, Opposite Party no. 2 has filed a petition for withdrawal of the said case (Annexure-3). Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Patna City, Patna in connection with Complaint Case No. 211(c) of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
