JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, some witnesses claimed that petitioner had also participated in the alleged crime and accordingly, he has been made accused in the present case. Moreover, according to prosecution case itself, it was co-accused, Laxman Yadav, who made indiscriminate firing causing death of the deceased.

Considering the aforesaid facts and circumstances as

No.11457 of 2016 (2) dt.15-03-2016 2/2 well as submissions of the parties and also taking note of this fact that some F.I.R. named accused have already been granted privilege of bail by different Benches of this Court, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S.
