The petitioner seeks bail in a case registered for the offences punishable under sections 387, 436 and other allied sections of the Indian Penal Code and section 10, 13, 16(B), 18, 19, 20 of the Unlawful Activities Prevention Act. The petitioner is not named in the F.I.R. Nothing has been recovered from possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Sukhari Mahto. Petitioner was also arrested and he is also said to have made exculpatory statement before the police accepting his guilt. Save and except the confessional statement of Sukhari Mahto and the petitioner himself, the police did not collect any tangible material against the petitioner.

Patna High Court Cr.Misc. No.21917 of 2015 (3) dt.08-09-2015 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Uday Shankar, Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Motipur P.S. Case No. 07 of 2015.
