None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-02-2019 Heard learned counsel for the petitioner. No one appears on behalf of the State to oppose this application. Petitioner is seeking anticipatory bail in connection with Srinagar Pujahan P.S. Case No. 57 of 2018 registered for the offences punishable under Sections 147, 323, 324, 342, 379, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Later on Section 307 of the Indian Penal Code was also added.

Learned counsel for the petitioner submits that there is no specific allegation against this petitioner. It is further submitted that the specific allegations are against Suresh Sah and Dukhi Sah. It is further submitted that the similarly situated accused namely Lalan Sah has been granted privilege of anticipatory bail by a learned coordinate Bench of this Court in

Patna High Court Cr.Misc. No.4095 of 2019(2) dt.05-02-2019 2/2 Cr.Misc.No.76366 of 2018 vide order dated 19.12.2018. The petitioner has got no criminal history.

In the given facts and circumstances, considering the submission that there is no specific allegation against the petitioner and co-accused has been granted privilege of anticipatory bail, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned Judicial Magistrate-1st Class, Bettiah, District-West Champaran in connection with Srinagar Pujahan P.S. Case No. 57 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
