The petitioner seeks bail in a case under sections 366, 120-B/34 of the Indian Penal Code.
The informant alleged that his daughter was kidnapped by Dharmendra Sharma and Akhilesh Sharma. Guddu Sharma is alleged to have disclosed this fact to the informant. Learned counsel for the petitioner submits that the victim appeared and disclosed the names of Dharmendra Thakur, Akhilesh Thakur, Shobha Thakur and Amresh Thakur and she alleged that all the four kidnapped her and took her to different places. The police brought the victim from Basti district in U.P.
It is submitted that the victim was in love with
Patna High Court Cr.Misc. No.22008 of 2015 (2) dt.08-07-2015 Akhilesh Sharma alias Akhilesh Thakur. It is also submitted that the case has been compromised and similarly situated co-accused Shobha Thakur and Amresh Thakur have already been granted anticipatory bail by the learned 5th Additional Sessions Judge, Saran at Chapra by order dated 29.06.2015 vide A.B.P. No. 1454 of 2015.
Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Saran at Chapra in connection with Maker P.S. Case No. 02 of 2015.
