The petitioner is apprehending his arrest in connection with Shahkund (Sajour) P.s.Case No.182 of 2018 dated 10.8.2018 , registered for offences punishable under Sections 341, 323, 324, 307, 354, 34 of the Indian Penal Code. Allegation as per FIR is that while the son of the informant was clicking photograph, the accused persons including the petitioner objected it and the petitioner assaulted by spade on his head.

Submission of the learned counsel for the petitioner is that son of the informant was clicking photographs of the daughter of the petitioner and they objected it as such there was some scuffle and due to that he has been falsely implicated making such allegations and the injury report shows that the

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bhagalpur in connection with Shahkund (Sajour) P.S.Case No.182 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
