Petitioner is in custody in connection with Bakhtiyarpur P.S. Case No. 490 of 2018 Special Case No. 9171 of 2018 for the offence under sections 30(a) © (d)/34/36 of Bihar Prohibition and Excise Act and Section 25(1-b) A/36/35 of Arms Act.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent and two co-accused have been granted bail in Cr. Misc. No. 78729 of 2018. It is alleged that petitioner fled away at the time of seizure of liquor and nothing was recovered from the possession of the petitioner.

Considering the fact that petitioner has no criminal antecedent and similarly circumstanced other co-accused have

Case No. 490 of 2018 Special Case No. 9171 of 2018.
