The petitioner seeks bail in a case under Section 363, 366(A) and other sections of the Indian Penal Code. The informant alleged that the petitioner kidnapped the victim. The victim made her statement under section 164 of the Cr. P.C. and disclosed that while she had gone to take tuition the petitioner kidnapped her in an auto rickshaw. The petitioner also brought her to his house when the case was lodged. It is submitted that during the course of investigation the supervising authority found that the victim was major and she was having love affair with the petitioner.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.22003 of 2015 (3) dt.12-08-2015 2/2 allegation made against the petitioner and the fact that victim did not raise any alarm when she was being taken to somewhere else on an auto rickshaw, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in Turkaulia P.S.
