2. The petitioner seeks bail in connection with Simari P.S. Case No. 359 of 2023 registered for the offence under Sections 147, 149, 341, 323, 354, 307, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have assaulted the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 13.10.2023.

6. Learned APP for the State vehemently opposed

Patna High Court CR. MISC. No.5783 of 2024(2) dt.17-02-2024 2/2 the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Buxar in connection with Simari P.S.
