The petitioners seek bail in anticipation of their arrest in connection with Manjhagarh P.S. Case No. 232 of 2018 dated 05.08.2018 instituted for the offences under Sections 366A and 34 of the Indian Penal Code. The 14 year old daughter of the informant did not come back home after she had gone out of her house for attending a coaching class. The informant suspected the hands of the petitioners and their father in the abduction of his daughter.
Learned counsel for the petitioner has drawn the attention of this Court to the 164 statement of the daughter of the informant. She has categorically stated
Patna High Court Cr.Misc. No.362 of 2019(2) dt.30-01-2019 2/2 that because of fear of scolding at home, she had run away. She has further specifically stated that the accused persons who have been named in the FIR have wrongly been framed by her father.
Regard being had to the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 232 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
