This application for grant of regular bail arises out of Chandi P.S. Case No. 147 of 2018, registered for the offence punishable under Sections 341, 323, 307, 302, 504 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. It is the case of the prosecution that in respect of a dispute over passage, the occurrence had taken place. It is alleged against co-accused Sudhar Yadav of having shot at one Pankaj Kumar, the informant's cousin, who died instantaneously. It is alleged against the petitioner that he shot at one Chandeo Singh, who received firearm injury in his left chest.

Patna High Court CR. MISC. No.4611 of 2020(5) dt.08-07-2020 2/2 corroborates the case of the prosecution, as disclosed in the First Information Report. The said Chandeo Singh received firearm injury in his left chest, as has been reported by the medical expert.

Learned counsel appearing on behalf of the petitioner has submitted that since the petitioner has no criminal antecedent and he has remained in custody since 22.11.2019, his prayer for regular bail may be considered favourably. I am not convinced with the submission made on behalf of the petitioner. Considering the gravity of the offence alleged in the First Information Report against the petitioner and the fact that the said allegation has been corroborated by the medical expert, this application is rejected.
