In this case, the petitioners who are ladies are seeking anticipatory bail in connection with Sanjhauli P.S. Case No.88 of 2018, registered for the offence punishable under Sections 290, 337, 353, 186, 504 of the Indian Penal Code and Section 30(a), 32(c) of the Bihar, Excise Prohibition Amendment Act. Allegation has been made that behind the house of the petitioners about 23.22 litres English wine has been recovered.
Learned counsel for the petitioners submits that they have been falsely implicated in the present case and
Patna High Court Cr.Misc. No.807 of 2019(2) dt.25-01-2019 2/2 nothing has been recovered from their conscious possession and they have got no criminal antecedent.
Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the 2nd District and Sessions Judge-cumSpecial Judge, Excise Rohtas, Sasaram, in connection with Sanjhauli P.S. Case no.88 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
