JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 This is an application for grant of anticipatory bail in connection with Sasaram (M) P.S. Case No. 160 of 2018, disclosing offences under Sections 30(a), 35, 38 of the Bihar Prohibition and Excise Act.

Allegation as per F.I.R. is of recovery of 296.32 liters liquor from the labour room and the petitioner is also named in the F.I.R. Further it appears that the petitioner is accused in two other cases, one is of similar nature.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession and he has falsely been implicated in this case. Though, he is accused in two other cases, but he is on bail. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.1787 of 2019(3) dt.23-01-2019 2/2 Having heard both sides, considering the above facts and circumstances of the case and criminal antecedents, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
