The petitioner is languishing in custody since 01.04.2015 in a case registered for the offences punishable under Sections 342, 323, 324, 307/34 and 114 of the Indian Penal Code. It is alleged that the petitioner caught Kamlesh Paswan with his hair and Shyam Bihari Paswan assaulted Kamlesh Paswan with axe on his neck.

It is submitted by learned counsel for the petitioner that the petitioner is agnate of the informant and accusation of assault is not levelled against the petitioner. A statement has been made in para 3 of the petition that the

Patna High Court Cr.Misc. No.22791 of 2015 (2) dt.10-07-2015 2/2 petitioner has no criminal antecedent and investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Tilauthu) P.S. Case No. 282 of 2014.
