The petitioners are apprehending arrest in connection with Kudra P.S. Case No. 324 of 2019 for the offence under Section 30(a) of the Bihar Excise and Prohibition Act, 2016. Allegation against the petitioner is that he was involved in the trade of liquor. A total of 71.80 litres liquor was recovered from one Akhilesh Chaudhary who disclosed the name of the petitioner.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

Considering the fact that the petitioners have no

No.8014 of 2020(2) dt.02-03-2020 2/2 criminal antecedent and nothing was recovered from their conscious possession or from the house of the petitioners, the Court is inclined to grant bail to the petitioners, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 3rd cum-Special Judge, Excise, Kaimur at Bhabhua in connection with Kudra P.S. Case No. 324 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
