JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.9.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The informant's motorcycle, mobile and other articles were robbed. Subsequently, the motorcycle was recovered in abandoned condition.

It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner nor the petitioner has been put on test identification parade. Statements to that effect have been made in paragraph nos. 12 and 13 of the petition.

No.5109 of 2015 (4) dt.05-05-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Singheshwar P.S. Case No. 78 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
