The petitioners are in custody since 27.3.2014 in
Patna High Court Cr.Misc. No.22597 of 2014 (6) dt.24-12-2014 2/3 connection with Manpur PS Case No. 01/2012 registered under sections 20, 22, 23, 24, 27A and 29 of the N.D.P.S. Act It is submitted on behalf of the petitioners that they were named in the F.I.R. on the basis of the confessional statements of two persons who were found in possession of Ganja which was being loaded on Bolero vehicle. It is submitted on behalf of the petitioners that some of the persons Brajesh Yadav and Ram Bahadur Patwari who were arrested from the place of occurrence have since been extended the privilege of bail. Subsequent thereto, it is submitted on behalf of the petitioners that one Nasim Mian who was also similarly situated and whose name figured in the confessional statement of these two petitioners has also been granted bail by this court on 17.9.2014 in Cr. Misc. No. 31863/2014.
Considering the aforementioned submissions and also the fact that the names of these two petitioners has surfaced in the confessional statement of co-accused who have already been granted bail, let petitioner Hari Mahto of Cr. Misc. No. 22597/2014 and petitioner Basant Mahto @ Babnant Mahto of Cr. Misc. No. 23302/2014 be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the District and Sessions
