JUSTICE PRABHAT KUMAR JHA ORAL ORDER 05-05-2015 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners seek bail in Paroo P.S. Case No. 243 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The son of the deceased alleged that his father was assaulted by the petitioners on such he came to his Darwaja where his father disclosed that Manoj Kumar assaulted him with knife, Pappu Kumar @ Mukesh assaulted him with iron rod. Thereafter, Monu and Sonu these petitioners are said to have assaulted the deceased with butt of pistol and iron rod.

Learned counsel for the petitioners submits that five injuries are found on the person of the deceased out of which four

Patna High Court Cr.Misc. No.6140 of 2015 (4) dt.05-05-2015 2/2 injuries are caused by sharp edged weapon and 5th injury is caused by hard and blunt object which was found on chest. On dissection 4 to 6th rib was found fractured and laceration on right side lungs and chest cavity. The 5th injury attributed to Pappu Kumar @ Mulesh as he was firstly alleged to have assaulted with iron rod. But, no injury was found on account of assault made by the petitioners.

Learned counsel for the informant did not dispute the facts.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Paroo P.S. Case No. 243 of 2014.
